Law for the Control of Export, Import and Others of Specified Hazardous Wastes and Other Wastes
The law regulates the export, import, transportation and disposal of specified hazardous and other wastes and implements the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and Their Disposal.
Some key provisions are set out below:
- Specified hazardous and other wastes are defined with reference to the Annexures of the Basel Convention.
- Any person who imports or exports specified hazardous and other wastes is required to obtain approval under the Foreign Exchange and Foreign Trade Act.
- The transported waste is required to be accompanied by related movement documents
- When imported wastes have been disposed of, the exporter or the competent authorities of the region of origin, shipment or transit are to be notified
- The Minister of Economy, Trade and Industry and the Minister of the Environment have the power to issue orders for exporters, importers, transporters of specified hazardous wastes to take necessary measures to prevent damage to human health and the environment, including measures for recovering or properly disposing of the specified hazardous wastes.
