Hazardous and Other Wastes Rules
The Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 were notified to ensure the safe handling, processing, storage, transportation, and disposal of 'hazardous waste', which is defined as any waste which by reason of characteristics such as physical, chemical, biological, reactive, toxic, flammable, explosive or corrosive, causes danger or is likely to cause danger to health or environment, whether alone or in contact with other wastes or substances.
The Rules prohibit the import of hazardous and other wastes specified in Schedule VI. Schedule VI includes entry A1180 for 'waste electrical and electronic assembles or scrap'.
However, the Rules permit the import of 'used electrical and electronic assemblies' with the permission of the Ministry of Environment, Forest and Climate Change (entry B1110 in Part B of Schedule III). The Rules also permit the import of ‘electrical and electronic assemblies (including printed circuit boards, electronic components and wires) destined for direct reuse and not for recycling or final disposal’ without the permission of the Ministry, but upon furnishing specified documentation (entry B1110 in Part B of Schedule III).
