Mining Law No. 3/2020
This 2020 Mining Law amends the 2009 Mining Law (Mining Law No. 4/2009). The Indonesian mining industry was faced with a complex legislative framework pursuant the 2009 Mining Law. The 2009 Mining Law removed a lot of administrative issues hampering the industry, but its unpredictable implementation and ongoing ad-hoc regulations left the section in need of further amendments.
The 2020 amendment to the Mining Law, which revises and modifies its 2009 version, provides a clearer framework for the industry and aligns with the government’s agenda of stimulating value adding downstream industrialization.
This law aims at improving national mining management, giving legal certainty and facilitating investment.
Under the 2020 Mining Law, the Indonesian Central Government, through the Ministry of Energy and Mineral Resources (MEMR), now has exclusive authority to issue licenses in the mining sector.
