Royal Decree 2857/1978 approving the General Regulation for the Mining Regime
The General Regulation for the Mining Regime implements the 1973 Mining Law. It indicates the procedures for permitting the exploration, exploitation or processing of mineral resources. It also provides for the undertaking of geological surveys and data collection as well as environmental assessments related to mineral development.
The state, alone or in association with private enterprises, may undertake the investigation of areas for mining, following the indications and standards set by the Ministry of Energy and Industry and executed by the provincial delegations of this Ministry, taking into account the protection of the environment.
The state can also declare reserve zones for areas where there are resources of national interest. The establishment of a reserve zone implies the declaration of national interest for the resources in that area.
