Energy Act of 2020 (Critical minerals provisions)

Last updated: 3 November 2022

The Energy Act of 2020 is framework legislation designed to modernise US energy policies to foster innovation across the board on a range of technologies that are critical to energy and national security as well as to environmental protection. Section 7002 of the law requires that the executive branch designate a list of critical minerals and update that list every three years and that the US Geological Survey (USGS) conduct domestic resource assessments of critical minerals and make that information publicly available.
In addition, the Act therein directs the Secretary, in consultation with the Energy Information Administration and other stakeholders, to develop a comprehensive forecast, entitled the “Annual Critical Minerals Outlook” of projected critical mineral production, consumption, and recycling patterns over the subsequent 1-year, 5-year, and 10-year periods. The Outlook will also include an assessment of the projected critical mineral requirements for national security, energy, economic, and technological needs, as well as the reliance of the US on foreign sources to meet those needs, taking into account the implications of potential supply shortages or disruptions.
