National Greenhouse Gas Emissions Reporting Regulations, 2016

These regulations introduce a single national reporting system for the transparent reporting of greenhouse gas emissions (including methane). This system will support the country’s National Greenhouse Gas Inventory and reporting obligations under the United Framework Convention on Climate Change (UNFCCC).

 

Annex 1 outlines activities and emission sources for which reporting is required. These cover fuel combustion, petroleum refining, fugitive emissions from fuels (including oil and natural gas), other emissions from energy production, transportation, among others.

 

Data providers fall into two categories. Data providers categorised as Category A are those responsible for an activity listed in Annex 1. Category B relates to any public, research or academic institution that holds greenhouse gas emission data or activity data relevant for calculating greenhouse gas emissions.

 

The regulations require Category A data providers to report the relevant greenhouse gases and associated activity data for all IPCC source categories where their capacity is equal or above established thresholds. The Technical Guidelines for Monitoring, Reporting, Verification and Validation of Greenhouse Gas Emissions by Industry stipulate the applicable reporting methodology. The oil and gas industry falls within tier 2 and 3 reporting standards (but activities related to the transport of CO2 can employ tier 1 methodology). Category B data providers shall provide data when requested by the competent authority.

 

Moreover, recordkeeping requirements are outlined, including the need to keep records for at least five years and make them available for inspection upon request. Authorities also have the power to conduct on-site facility or installation specific inspections in order to verify reported emissions or to require verification by an independent assessor.

 

The regulations define further reporting requirements, including procedures for the registration of data providers, reporting boundaries, alternative reporting methods, additional means for verification and validation of information, conditions related to data publishing, and applicable offences and penalties.
